These Terms of Service ("Terms") govern your access to and use of www.blackstonesboston.com, any related mobile or digital services, and purchases made in-store or online (collectively, the "Services").
BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
1. ELIGIBILITY & ACCOUNT SECURITY

3. PRICING, PAYMENT & TAXES

We may cancel or refuse any order. If payment has been processed, refunds will be issued to the original payment method.
You are responsible for applicable sales taxes, duties, and other governmental charges.
4. SHIPPING, TITLE & RISK OF LOSS
Orders are shipped via third-party carriers. Delivery times are estimates only.
TITLE AND RISK OF LOSS TRANSFER TO YOU UPON OUR DELIVERY OF GOODS TO THE CARRIER, EXCEPT WHERE PROHIBITED BY LAW.
We are not liable for delays, loss, or damage caused by carriers or events outside our control.
5. RETURNS, REFUNDS & CHARGEBACKS

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE AT ISSUE.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS, SO THESE MAY NOT FULLY APPLY.
14. PRODUCT LIABILITY & SAFETY
Nothing in these Terms excludes liability that cannot be limited under applicable law.

16. FORCE MAJEURE
We are not liable for failure or delay due to events beyond our control, including acts of God, pandemics, supply chain disruptions, labor disputes, or carrier failures.
17. TERMINATION & SURVIVAL
We may terminate or suspend access at any time.
Provisions relating to liability, indemnification, intellectual property, and dispute resolution survive termination.
18. GOVERNING LAW & VENUE
These Terms are governed by the laws of the Commonwealth of Massachusetts.
Any permitted court action shall be brought exclusively in Boston, Massachusetts.
19. DISPUTE RESOLUTION & CLASS ACTION WAIVER
You agree that disputes shall be resolved through binding arbitration in Massachusetts, except where prohibited.
YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.
You may opt out of arbitration within 30 days of first use by notifying us in writing.
20. ELECTRONIC COMMUNICATIONS
You consent to receive communications electronically, including notices and agreements.
21. COMPLIANCE WITH LAWS
You agree to comply with all applicable laws, including export and sanctions laws.
22. CHILDREN’S USE
The Services are not directed to children under 13. We do not knowingly collect data from children.
23. SEVERABILITY & ASSIGNMENT
If any provision is unenforceable, the remainder remains in effect.
We may assign these Terms without restriction.
24. ENTIRE AGREEMENT
